Notice is hereby given that a Six Year Road Plan for the Village of Murdock, Nebraska as required by NEB. REV. STAT. Sec.39-2119 et seq. R.R.S. has been recommended for approval the Chairman and Village Board of Trustees that a Public Hearing be held on Six Year Road and Street Plan on 17 th day of September, 2025, beginning at 7pm, at the Murdock Village Hall at which time objection to or recommendations for said plan
will be heard.

MINUTES
VILLAGE OF MURDOCK
August 12, 2025

The Village of Murdock Board of Trustees met on Tuesday, September 2, 2025, at 7 p.m. at the Village Hall. Roll call as follows; Dave Nuss, Lee Towle, Michelle Chesnutt, Tom Miner and clerk were all present.

The minutes from the previous August regular meeting were read. Motion was made by Michelle Chesnut and seconded by Tom Miner to approve the meeting minutes, and the motion carried unanimously by RCV.
The following checks were approved for payment: Windstream ph/int-488.59; OPPD elect.-998.91; Cass Co. RWD#2 768,000 gals-4224; St of NE PHE Lab water test-15.00; Column Software, PBC publishing-Aug ’25 minutes; Faubion post./reg wat. Oper./Conf space class -492.90; R. Stroy payroll-1549.86; Mowen Own Lawn and Garden, LLC mowing-250.00; Ashland Disposal Service garbage-2906.22; St of NE Dept of Revenue Aug sales tx-114.44 (Electronic Payment); Black Hills Energy-gas service-200.48; Zito Media-Internet-63.50; Frontier Co-Op-fuel-32.87; Meeske Hardware-weed/grass killer-marking paint-131.35; R. Stroy-2nd Line/Cell Service-40.97; Municipal Supply-Curb stops/etc-519.18; Cornhusker Press-watercards-1018.55;

The following discussions/updates were held concerning old business.

Burton Asphalt was once again discussed. As of the September Board Meeting, Burton Asphalt did not appear as expected from August 15–18 to fulfill their contractual obligations, nor has there been any communication from them since their message on July 24. At this point, the Board is evaluating potential legal actions and seeking guidance from the League of Municipalities. Further updates will be provided as the situation develops.

On August 26th, a kickoff meeting was held with representatives from the Village of Murdock, Pavers (Contractor), and JEO Consulting Group (Engineer) concerning the Second Street project. During the meeting, a contract modification was discussed for concrete curb and gutter replacement on both sides of Second Street. A Change Order in the amount of $16,603.23 was approved as an addition to the original plan. A motion to approve this additional cost was made by Chesnut, seconded by Miner, and unanimously approved by roll call vote. The tentative start date for construction is on or before October 8th, 2025.

A letter was sent to JEO Engineering requesting their services as professional engineer to develop a plan addressing wastewater lagoon requirements. Vegetation, tree growth, landscaping, and grading concerns have been identified. A contractor has been authorized to start initial work on tree removal and fill dirt, with a $10,000 bid approved for these activities. The motion was made by Towle and seconded by Miner, with all members approving by roll call vote.

In New Business:
Representatives from the Cass County Sheriff’s Department, including Matt Watson (Chief Deputy) and Reid Richter (Captain), attended the village board meeting to address any questions from the Board or citizens. The discussion included topics related to UTV, ATV, 4-Wheeler, and Golf Cart usage within villages. Existing State Laws regulate their use and set age limits for drivers. Additionally, the county currently has a steering committee reviewing other community-related issues associated with these vehicles. The committee is still in progress, and no decisions or rulings have been made at this time.

However, the regulation of golf carts will be determined by each village through its own ordinances.
Three members of the Murdock Rural Fire Protection District met with the Board to review the new Interlocal Agreement. Questions were raised about parts of the proposal and will be addressed by the Rural Fire District. The agreement may be signed at the October 2025 meeting and would take effect January 1, 2026.

Lee Towle raised the topic of engaging a new town attorney with expertise in representing small towns and villages. Lee will explore options and intends to invite a prospective candidate to our meeting scheduled for October 7th.

Board Members reviewed the new “One & Six year” street plan for 2026. Modifications were made from last meeting and Notice for Hearing on these plans will be September 17th, 2025 at 7pm, at the Murdock Village Hall.

The date for the Public Hearing for the Annual Budget, Budget Waiver & One and Six Year Plan’s is set for September 17th @ 7pm, at the Murdock Village Hall.
There being no further business, the motion was made by Chesnut and second by Towle that the meeting close and the next regular meeting will be Tuesday October 7th, 2025, at 7:00 p.m. at the Murdock Village Hall, Motion carried unanimously by RCV.
